Terming the status of air pollution extremely serious, the Supreme Court has banned the operation of 15 years old petrol and 10 year old diesel vehicles in Delhi-NCR. The apex court asked the transport departments that if such vehicles were found on the roads of Delhi-NCR, they would be seized.
A bench of Justice Madan B Lokur, Justice S Abdul Nazir and Justice Deepak Gupta termed the status of air pollution in Delhi-NCR as horrific. Referring to the media report, the bench said that the condition is that people can not get out for a morning walk.
The bench has asked the Central Pollution Control Board (CPCB) and Transport Department to issue a list of 15 year old petrol vehicles and 10 year old diesel vehicles. The bench has directed to publish advertisements in newspapers in this regard. In addition, the bench has asked CPCB to create a social media account as soon as possible so that the citizens can file complaints related to pollution. The concerned authority has been instructed to take action on these complaints.
Along with this, the bench has allowed the Environmental Pollution Control Authority (EPCA) to take up the remedial steps before the pollution level given under the Grade Response Action Plan (GRAP).
The Supreme Court has given these instructions on the report filed by amicus curiae Aparajita Singh. In fact, Aparajita Singh told the bench that the situation of pollution in the capital has worsened so that there is a need to take action soon.
It may be noted that before this, the National Green Tribunal (NGT) had banned the operation of 15-year-old petrol vehicles and 10-year-old diesel vehicles in Delhi and the top court has dismissed the petition challenging NGT order.
During the hearing on Monday, the bench cited the media report that pollution in Delhi has worsened so much that people can not go to the morning walk. The bench told the Additional Solicitor General (ASG) ANS Nadkarni present on behalf of the Central Government, “Have you gone to the old Delhi railway station?”
Poor people have to work hard to run their livelihood. The kind of work they need to do is more than those who travel in the Lodhi Garden. Poor laborers do heavy physical labor. Can you stop them by telling them to work? It is not safe to work in the morning. This is a very serious situation. This is a horrific situation. “On this, the ASG said that he supports amicus curiae’s suggestions.
Along with this, Amicus Curiae presented the report prepared by EPCA and the burning of waste in Dwarka, Narail, Bawana, Mundka and Nangloi etc. On this, the bench asked Delhi Government and DSIIDC to file an affidavit within two days. The next hearing will be on November 1.
